This Privacy Policy is applicable to Psych Hub (“we,” “our,” or “us”) and our collection of information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, as defined by applicable privacy laws (“Personal Information”) via use of our services (the “Services”), which collectively include:
- Browsing our website or affiliated websites;
- Interacting with us via email, telephone, social media, or other communications; and
- the use of our products and services, including:
- Mental Health Organizations, Employers, and other entities (“Clients”) may contract with us to license the use of our application and give access to their employees, practitioners, and other third parties (“Authorized Users”), as solely decided by them, by creating users who access the application with their email address and credentials;
- self-managed accounts; and
- Psych Hub’s Healthcare Provider Marketplace (“Marketplace”)
By accessing and using the Services or otherwise providing us with Personal Information, you agree to the terms and conditions of this Privacy Policy. If you do not agree to the terms and conditions of this Privacy Policy, then please do not provide us with your Personal Information. Please note, however, that if you choose to limit the information that you provide to us while using the Services, you may not be able to use or participate in certain features of the Services.
We reserve the right to revise or update this Privacy Policy at any time, and you should periodically read the Privacy Policy to learn of any revisions or updates. If the revision or update is material, we will provide you notification via email or banner on the Services; however, for non-material revisions or updates, we will notify you by posting the revised or updated Privacy Policy and its “Last Modified Date” on our website. Using the Services thereafter constitutes your agreement to and acceptance of the Privacy Policy and its revisions or updates.
As described in this Privacy Policy, Client administrators will have access to certain account information of Authorized Users to facilitate management of the Services.

We may collect the following Personal Information via the applicable Services directly from you.
If you use any feature of the Services that allows you to submit personal information relating to another individual (“Third-Party Data”), you acknowledge, represent, and agree (a) that you have the authority of the relevant other party for us to access and use the relevant Third-Party Data, and (b) that you have notified these other parties and informed them how their information is collected and used by us to provide the Services.
Where applicable, we reserve the right to identify you as the person who has made the referral in any messages that are sent to other parties. We use Third-Party Data to (a) contact such party using the Third-Party Data provided, and/or (b) provide the services requested.

- Carry out market research to understand how to improve our services and their delivery.
- Create and manage marketing campaigns.
- Generate sales leads and increase our market share.
- Analyze user clicks and usage of the application and website to improve user experience and maximize usage of our services.
- Manage our website and application to maintain and deliver the contracted functionality and services.
- Enforce our website and application terms and/or separate contracts (if applicable) with you
- Prevent fraud and other prohibited or illegal activities.
- Protect the security or integrity of the website, application, our business or services.
- Or otherwise, as disclosed to you at the point of collection or as required or permitted by law.
Please note that sometimes we may record the video conferencing call in which you participate to analyze and improve our staff’s communication skills.
- How We Share Personal Information
- Service Providers & Contractors: We may share your Personal Information with third-party service providers who assist us in operating our website, conducting our business, or serving you. These service providers are obligated to protect your information and use it only for the purposes for which it was provided.
- Financial institutions and payment processors. We may disclose certain Personal Information and Purchase Data to financial partners as necessary to fulfill your purchases.
- Third-Party Healthcare Providers. We may disclose information provided via the Marketplace to facilitate the Services, including Marketplace Identifiers and Marketplace Redirection Data.
- Authorized Representatives. If another individual is managing your account or access to the Services on your behalf (for example, a Client managing access for Authorized Users), as authorized by you or as a personal representative under applicable law, that person may be able to view all Personal Information about you in the Services.
- Analytics Partners. We may share Personal Information, including without limitation your contact information, with entities that perform marketing or data aggregation services on our behalf. We may share Personal Information, including without limitation your device information, location, usage data, and IP address, to analytics-based technologies to assist with personalization, advertising, and marketing.
- In the Event of Merger, Sale, Divestitures, or Change of Control. We reserve the right to transfer Personal Information to a buyer or other successor in interest that acquires rights to that information as a result of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of us or substantially all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about you is among the assets transferred.
- With Your Consent. We may share your Personal Information for other purposes pursuant to your consent ( e.g., you may opt-in to sharing of Account Activity Data with your medical providers or employers) or at your direction (e.g., facilitating your requests via Marketplace).
- Other Disclosures. We may disclose Personal Information if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) conform to legal requirements and comply with any court order, law, or legal process, including responding to any government, law enforcement, or regulatory request; (ii) enforce our agreements, including between you and us, and any other documents included or referenced therein (all of which are incorporated into and made a part of this Policy by reference); (iii) fulfill the purpose for which you provide it; (iv) detect, prevent, or otherwise address fraud or security issues; or (v) protect against harm to our, your, or third parties’ rights, property, or safety.
- How We Secure Personal Information
We maintain appropriate safeguards using industry standard technology to heighten the security, accuracy, and privacy of any Personal Information we have collected, and we have put in place reasonable precautions to protect information from loss, alteration, and misuse. While we implement these measures, please note that 100% security is not possible, and we cannot guarantee that the security measures we have in place to safeguard Personal Information will never be defeated or fail, or that those measures will always be sufficient or effective.
- Transfer of Personal Information to a Third Country
If you do not reside in the United States and provide Personal Information to us, please note that your Personal Information will be transferred, processed, collected, used, accessed and/or stored in the United States and subject to U.S. laws. The laws in the United States may not provide the same protections for your Personal Information as the jurisdiction in which you are located. Do not provide your Personal Information to us if you do not want this information to be transferred or processed outside of your country, or if the laws in your country restrict such transfers.
- Minors
The Services are not directed to, and we do not knowingly collect Personal Information from, children under the age of 16 or minors (as defined by applicable laws). If you are a minor, please do not attempt to fill out our forms or send any Personal Information about yourself to us. If a minor has provided us with Personal Information without parental or guardian consent, the parent or guardian should contact us immediately to remove the relevant Personal Information and unsubscribe the minor. If we become aware that a minor has provided us with Personal Information, we will take steps to promptly delete such information from our files.

We offer the following rights to all individuals regardless of their location or applicable privacy regulations.

You have the right to obtain information about what Personal Information we process about you or to obtain a copy of your Personal Information.
If you have provided Personal Information to us, you may contact us to obtain an outline of what Personal Information we have about you or a copy of the information, including:

- The categories of sources from which the Personal Information is collected;
- The business or commercial purpose for collecting or selling Personal Information;
- The categories of third parties with whom we share Personal Information;

If you are an Authorized User of the application, you can log in to see the Personal Information in the account or approach the Client from whom you have been granted access to the Services for more information.
- Change or correct your Personal Information.
You have the right to update or correct your Personal Information or ask us to do it on your behalf.
You can edit your information through the user account in the application or ask us to change or correct it by contacting us at support@psychhub.com.
- Delete or erase your Personal Information.
Subject to applicable laws and exceptions, you have the right to request the deletion of your Personal Information.
- Object to the processing of your Personal Information.
You have the right to object to our processing of your Personal Information for direct marketing purposes. This means that we will stop using your Personal Information for these purposes.
- Opt-out of Third-party Disclosures
You have the right to opt-out of the disclosure of Personal Information about you for monetary or other valuable consideration.
In accordance with the California Consumer Privacy Act, we recognize and honor Global Privacy Control (GPC) signals. GPC is a browser-based setting that communicates your preferences regarding the sale or sharing of personal information. If we detect a GPC signal from your browser, we will process it as a valid request to opt out of the sharing of your personal information, as defined under the CCPA.
Additionally, we may "share" personal information, as defined by California privacy law, with analytics providers to help improve our Services, track usage, and enhance user experience.
We use Google Analytics on our Sites to help us analyze traffic and improve services. - Right to Limit Use and Disclosure of Sensitive Personal Information
You may request specific limitations on further sharing, use, or disclosure of your Sensitive Personal Information that is collected or processed for “the purpose of inferring characteristics about a consumer” and outside of the scope of services requested. However, we do not collect or process Sensitive Data for this purpose.

To help protect your privacy and maintain security, we will take steps to verify your identity before processing your request. If you request access to or deletion of your Personal Information, we may require you to provide any of the following information: name, email address, telephone number. When you make such a request, you can expect the following:
- As required under applicable law, we will verify your identity. You will need to provide us with your email address and full name. We may ask for additional information if needed.
- We will confirm that you want your information accessed, corrected, and/or deleted.
- We will confirm our receipt of your request within 10 days. If you have not received a response within a few days after that, please let us know by contacting us at the webpage or phone number listed below.
- We will respond to your request within 45 days upon receipt of your request. If necessary, we may need an additional period of time, up to another 45 days, but we will reply either way within the first 45-day period and, if we need an extension, we will explain why.
- In certain cases, a request for access, correction, or deletion may be denied. For example, if we cannot verify your identity, the law requires that we maintain the information, or if we need the information for internal purposes such as providing Services or completing an order. If we deny your request, we will explain why we denied it and delete any other information that is not protected and subject to denial.
You may designate an authorized agent to request any of the above rights on your behalf. You may make such a designation by providing the agent with written permission, signed by you, to act on your behalf. Your agent may contact us to make a request on your behalf. Even if you choose to use an agent, we may, as permitted by law, require:
- The authorized agent to provide proof that you provided signed permission to the authorized agent to submit the request;
- You to verify your identity directly with us; or
- You to directly confirm with us that you provided the authorized agent permission to submit the request.
We will not discriminate against you for exercising any of your rights under privacy laws. This means we will not deny you goods or services, charge you different prices or rates for goods or services (including through the use of discounts, other benefits, or by imposing penalties), provide a different level or quality of goods or services, or suggest that you may receive a different price, rate, or level of quality for goods or services as a result of exercising your rights under privacy laws.
- How Long We Keep Your Personal Information
We retain information as long as it is necessary to provide the services to you and our clients, subject to any legal obligations to further retain such information.
We may also retain information to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce our Terms of Service and take other actions permitted by law.
The information we retain will be handled following this Privacy Policy.
Information connected to you that is no longer necessary and relevant to provide our services may be de-identified or aggregated with other non-personal data. This information may provide insights that are commercially valuable to Psych Hub, such as statistics of the use of the services.
- How to select your communications preferences
You may choose to receive or not receive marketing communications from us. Please click the “Unsubscribe” link in the email we sent you to stop receiving marketing communications.
Even if you opt-out of receiving marketing communications, we may still communicate with you regarding security and privacy issues, servicing your account, fulfilling your requests, or administering any promotion or any program in which you may have elected to participate.
